Online Athlete Waiver and Video and Publicity Release
W-2026.2-ONLINEREAD CAREFULLY. THIS AGREEMENT INCLUDES AN ORDINARY NEGLIGENCE RELEASE, A LIMITED INDEMNITY, AND A VIDEO AND PUBLICITY RELEASE. IT AFFECTS MY RIGHT TO SUE AND AUTHORIZES PROMOTIONAL USE OF MY SUBMITTED WORKOUT VIDEOS.
This agreement applies to my participation in Garage Games Masters Tour Online 2026, organized by The GarageGames Series LLC (GARAGE GAMES). In consideration of permission to participate, I agree as follows.
1 Participation and released parties
Participation means my preparation specifically for this competition, workout setup, warm-ups, attempts, recording, and submission. This agreement covers this online competition only. A later in-person competition requires separate registration and agreements.
Released Parties means The GarageGames Series LLC and its members, managers, officers, directors, employees, contractors, agents, judges, officials, and volunteers acting in connection with this competition. Independent gyms, property owners, equipment providers, and people helping me are not Released Parties merely because I use their services.
2 My location and equipment
I may perform the workouts at a gym, home, garage, or another location I choose if I have permission and can follow the standards safely. GARAGE GAMES does not select, operate, inspect, maintain, or approve my location or equipment.
I am responsible for checking my exercise area and equipment for hazards and arranging appropriate assistance, spotting, and safety measures. I will keep cameras, supports, and cables outside exercise paths. Competition requirements do not require me to continue in unsafe conditions.
3 My condition and the risks
I am at least 18 when I accept. I understand the workouts and believe I have the skill and physical ability to attempt them safely. If uncertain about my ability or health, I will obtain appropriate professional advice. I will not attempt work beyond my ability and will stop if conditions or symptoms make continuing unsafe.
Strenuous exercise and competitive lifting can cause strains, falls, collisions, dropped-weight or equipment injuries, overexertion, dehydration, heat illness, rhabdomyolysis, and cardiac or other emergencies. Injuries may cause permanent disability, paralysis, or death. Fatigue, competitive pressure, repeated attempts, and recording arrangements can increase risk. Help may be delayed, particularly if I am alone.
I voluntarily accept inherent risks, including those I cannot predict. This acknowledgment describes activity risks. The separate ordinary-negligence release is in Section 5.
4 Remote judging and emergency arrangements
GARAGE GAMES judges review submitted recordings afterward to determine competition scores. They do not watch my attempts live, supervise my exercise, assess my medical fitness, or provide emergency monitoring. A published workout, an accepted submission, or an official score is not confirmation that my technique, equipment, surroundings, or participation are safe.
GARAGE GAMES does not provide an on-site judge, coach, spotter, first-aid provider, medical staff, or emergency response at my location. I am responsible for arranging access to help, a way to contact local emergency services, and any medical precautions appropriate to me. I will not rely on the submission system or a message to a judge to obtain emergency assistance. I am responsible for my own medical expenses, subject to applicable law. This agreement does not eliminate a duty that the law imposes on anyone who actually provides assistance.
5 Release of ordinary negligence claims
TO THE EXTENT PERMITTED BY APPLICABLE LAW, I RELEASE AND DISCHARGE THE RELEASED PARTIES FROM CLAIMS I HAVE ARISING FROM MY PARTICIPATION FOR PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE CAUSED IN WHOLE OR IN PART BY A RELEASED PARTY'S OWN ORDINARY NEGLIGENCE. THIS INCLUDES ORDINARY NEGLIGENCE IN SELECTING OR DESIGNING WORKOUTS, SETTING COMPETITION STANDARDS, PROVIDING COMPETITION INSTRUCTIONS OR WARNINGS, ADMINISTERING OR JUDGING THE COMPETITION, AND PROVIDING ASSISTANCE IF ASSISTANCE IS ACTUALLY GIVEN. THE RELEASE APPLIES WHETHER THAT ORDINARY NEGLIGENCE IS A SOLE OR CONCURRENT CAUSE.
THIS AGREEMENT DOES NOT RELEASE GROSS NEGLIGENCE, RECKLESSNESS, WILLFUL OR INTENTIONAL MISCONDUCT, OR ANY CLAIM OR LIABILITY THAT APPLICABLE LAW DOES NOT ALLOW TO BE RELEASED. IT DOES NOT WAIVE THE INDEPENDENT RIGHTS OF ANOTHER PERSON WHOM I HAVE NO AUTHORITY TO BIND.
I agree not to sue a Released Party on a claim validly released by this section. That promise does not prevent me from asserting a claim excluded from the release, challenging this agreement's validity, reporting conduct to an authority, or exercising a right that cannot lawfully be waived.
6 Limited indemnity for claims by other people
TO THE EXTENT PERMITTED BY LAW, I WILL INDEMNIFY A RELEASED PARTY FOR DAMAGES AND REASONABLE LEGAL COSTS ARISING FROM A THIRD PARTY'S CLAIM, BUT ONLY TO THE EXTENT CAUSED BY MY OWN NEGLIGENT OR WILLFUL CONDUCT DURING PARTICIPATION OR MY KNOWING SUBMISSION OF MATERIAL I HAVE NO RIGHT TO PROVIDE. I DO NOT AGREE TO INDEMNIFY ANYONE FOR THEIR OWN NEGLIGENCE OR OTHER MISCONDUCT, FOR A CLAIM I BRING MYSELF, OR FOR LIABILITY THAT CANNOT LAWFULLY BE SHIFTED TO ME.
The Released Party must give me reasonable notice of the claim and an opportunity to respond. I have no duty to take over its defense or pay a settlement made without my consent.
7 Video and publicity release
I grant GARAGE GAMES a non-exclusive, worldwide, royalty-free license to copy, edit, publish, display, distribute, and broadcast my submitted workout recordings, in full or as clips, together with my name, image, likeness, and voice contained in or accompanying them, for coverage, results reporting, highlights, and promotion or advertising of GARAGE GAMES competitions. This includes websites, social media, email, print, and other media. GARAGE GAMES may authorize its personnel and service providers to carry out these uses on its behalf, within these same limits. I retain any ownership rights I have in the original recordings.
TO THE EXTENT PERMITTED BY LAW, THIS PERMISSION IS PERPETUAL AND IRREVOCABLE, CONTINUES AFTER THE COMPETITION, AND DOES NOT REQUIRE ADDITIONAL PAYMENT, NOTICE, OR MY APPROVAL OF EACH USE. I RELEASE THE RELEASED PARTIES FROM CLAIMS BASED ON MY OWN PRIVACY OR PUBLICITY RIGHTS ARISING SOLELY FROM USES AUTHORIZED BY THIS SECTION.
Edits may include cropping, captions, excerpts, and combining footage into highlights, but must not materially misrepresent my performance or statements. This permission does not authorize selling my footage for unrelated uses, suggesting that I endorse an unrelated product or service, or publicly displaying my scorecards or private registration information. It does not release claims for uses outside this permission, defamatory uses, or rights that applicable law does not permit me to waive. I cannot grant another person's rights. The submitted-material requirements in Terms Section 10 also apply.
8 Applicable law and separate obligations
Texas law governs this agreement, and an action arising from it must be brought in a state court in Tarrant County, Texas, or a federal court serving that county, except where applicable law requires otherwise. This choice does not displace mandatory protections or public-policy limits that apply to my participation or claim. If a provision is unenforceable, it is omitted to the extent necessary; the remaining provisions continue only to the extent permitted by law.
The Online Competition Registration Terms separately govern entry, submissions, judging, refunds, results publication, administrative use of submitted materials, and optional profile photographs. They do not expand the releases in Sections 5 and 7 or the indemnity in Section 6. Any agreement I make with my chosen gym or property owner is separate.
9 My acknowledgment and electronic signature
I HAVE READ AND UNDERSTAND THIS AGREEMENT, INCLUDING THE ORDINARY NEGLIGENCE RELEASE, LIMITED INDEMNITY, AND VIDEO AND PUBLICITY RELEASE. I ACCEPT VOLUNTARILY AND INTEND MY CHECKED ACCEPTANCE BOX AND TYPED LEGAL NAME TO SIGN IT ELECTRONICALLY.
Online Competition Registration Terms
T-2026.16-ONLINEThese Terms govern my entry to Garage Games Masters Tour Online 2026 (the Competition), organized by The GarageGames Series LLC (GARAGE GAMES). I perform and record the workouts at a location I choose. GARAGE GAMES judges review my submissions remotely. I accept these Terms together with the Online Athlete Waiver and Video and Publicity Release (the Waiver).
1 Eligibility and personal entry
1.1 I am at least 18 years old when I register and meet the Masters Tour eligibility requirements. For this Competition, my age division is based on my age on January 30, 2027, and I must be at least 30 on that date. My registration information, including date of birth, gender division, and Rx or Scaled election, must be accurate.
1.2 False eligibility information or another person competing under my identity will result in disqualification, removal from standings, and forfeiture of awards or placing. My registration is personal, non-transferable, and limited to this Competition. I may not sell it, assign it, defer it to another season, or transfer it to another competition.
1.3 I cannot edit my date of birth after registration. I may request correction of inaccurate registration information at legal@thegaragegames.com. Entry does not guarantee a placing, award, or championship invitation. Any later championship entry is separate.
2 Registration and submission deadline
2.1 The submission window opens December 1, 2026, at 12:00 AM Central Time and closes December 15, 2026, at 11:59 PM Central Time. I must perform and record every attempt I submit within that window; recordings made before it opens are not eligible. Registration remains open until that same closing deadline. Registering during the window does not extend my deadline.
2.2 I must complete payment and send a complete final submission through my athlete page before the closing deadline. The system's recorded receipt time controls. Saving draft links or scorecards, uploading a video to YouTube, or emailing materials to staff is not a final submission.
2.3 I am responsible for allowing time for recording, uploads, video processing, link checks, and final submission. Problems with my devices, internet connection, chosen location, or third-party video service do not automatically extend the deadline. If I cannot submit, I should report the problem promptly to jonathan@thegaragegames.com; reporting it does not itself create an extension. Competition-wide changes are addressed in Sections 7 and 8.
3 Standards and one final submission
3.1 I will follow the official Workouts and Movement Standards, the Video Recording and Submission Standards, and the division rules linked on the Competition and athlete pages. The online video standards control online recording and submission requirements, including the remote-judging clarification for Event 2B; the movement standards govern the workouts otherwise. I will also follow GARAGE GAMES competition instructions. The Waiver governs the safety and liability matters it addresses.
3.2 My submission must include one continuous video for Event 1, one continuous video for Events 2A and 2B together, and one continuous video for Event 3, and the required completed scorecards. Each recording must meet the Video Recording and Submission Standards published for the Competition, including how it is filmed and the introduction at its start. All recordings must show my actual attempts. My scorecards must accurately state my claimed results and required tiebreaks, clean weight, and bike type.
3.3 I may save drafts during the window. I submit all three events together using the final Submit action. Once that submission is accepted, I cannot edit or replace my attempts, video links, or scorecards. A request from GARAGE GAMES for clarification does not authorize a new or replacement attempt.
3.4 I must retain the original recordings and keep every submitted YouTube video viewable by judges, without sign-in, until GARAGE GAMES confirms my results. Unlisted is recommended; Public is acceptable; Private is not. Anyone with an Unlisted link may view or share it. I must not delete or restrict a submitted video while its review is pending.
4 Remote judging and official results
4.1 GARAGE GAMES judges determine official scores from the videos and scorecards. My claimed score is not my official score. Receiving a submission or accepting a link does not establish compliance with standards or guarantee a valid result. Missing, unreadable, inaccessible, incomplete, edited, or noncompliant evidence may result in a reduced score, an invalid attempt, or disqualification under the competition rules.
4.2 GARAGE GAMES may request clarification and correct judging, scoring, or eligibility errors, including after scores have been published. I must respond to a clarification request by any reasonable deadline stated in it. A head judge may correct an official score; my inability to edit a final submission does not prevent that correction.
4.3 GARAGE GAMES considers scoring queries case by case. Its head judge's determination is final for competition administration, subject to any legal right that cannot be waived. Judges do not provide live workout supervision or emergency assistance.
4.4 My entry becomes eligible for national standings when all required scores for Events 1, 2A, 2B, and 3 are official. Placement may change as other athletes are scored or results are corrected.
5 Conduct and awards
5.1 Abusive, threatening, harassing, fraudulent, or unsportsmanlike conduct connected with the Competition, including in videos, messages, email, or online communications, may result in disqualification without refund and exclusion from future GARAGE GAMES events. Reports may be sent to legal@thegaragegames.com. GARAGE GAMES will review good-faith reports with enough information to permit review.
5.2 A disqualified athlete forfeits any placing or award. I am responsible for taxes on anything of value I receive. No award or invitation is promised merely because I register or submit.
6 Publication of results
6.1 Competition results are public and may be indexed by search engines. GARAGE GAMES may publish my name, represented gym, age division, Rx or Scaled classification, official scores, ranking, finishing position, and applicable participation status on Competition, season, national, and championship standings. A hometown or Instagram handle I choose to provide may appear alongside my results.
6.2 Public results are intended to remain part of the permanent competition record. My consent to that publication does not remove rights provided by applicable privacy law. Requests concerning personal information or verified result inaccuracies go to legal@thegaragegames.com. GARAGE GAMES will correct verified inaccuracies and may correct or remove results for scoring, judging, or eligibility reasons.
6.3 GARAGE GAMES does not publish my date of birth, exact age, address, contact details, emergency contact, height, or weight as leaderboard information. My age division identifies an age band. This does not prevent information I include in my own publicly accessible recording from being seen by its viewers.
6.4 I authorize accurate publication described here. This authorization does not waive a claim for unauthorized disclosure or a right that applicable law does not permit me to waive.
7 Changes to the Competition
7.1 GARAGE GAMES may change a workout, standard, division, or submission window, or cancel the Competition, for safety, technical failure, insufficient entries, or other operational reasons. It will communicate material changes through the Competition or athlete pages and, where practicable, registration email. Changes apply consistently to affected athletes and remain subject to Section 8 and applicable law.
7.2 A change to the competition rules does not amend the signed Waiver or these Terms. Material changes to an athlete's legal obligations require separate notice and acceptance where required by law.
8 Refunds
8.1 Except for Sections 8.2 and 8.3 or where law requires otherwise, entry fees are non-refundable and non-transferable. This includes withdrawal, injury, failure to complete the workouts, a missed submission deadline, invalid or unavailable evidence, a reduced official score, refusal of entry, or disqualification. Registration does not purchase a guaranteed valid score or placing.
8.2 If GARAGE GAMES cancels the Competition, changes the submission dates and I decline the revised window, or cancels or merges my division, GARAGE GAMES will refund my registration fee in full, including any payment processing fee paid with it. For cancellation or a canceled or merged division, the refund will be issued within 30 days of the change. For a changed window, I must request the refund at legal@thegaragegames.com within 30 days after notice; GARAGE GAMES will issue it within 30 days after the request.
8.3 A workout or standard change alone does not create a refund. If GARAGE GAMES ends the Competition early or a failure of its submission system prevents completion of the required submission and it provides no reasonable replacement opportunity, an affected athlete may request a full refund at legal@thegaragegames.com within 30 days after the announced closure or failure. GARAGE GAMES will issue the refund within 30 days after the request. This covers a failure of the Competition or its system, not an individual athlete's device, connection, or evidence problem.
9 My chosen facility
9.1 I am responsible for obtaining permission to use my chosen location and for complying with its rules, fees, and any separate facility waiver. GARAGE GAMES has no host facility for this online Competition. A gym I name in registration is not thereby a GARAGE GAMES host, agent, or Released Party. A separate facility agreement does not replace the Waiver or these Terms.
10 Submitted materials and personal information
10.1 I retain any ownership rights I have in submitted recordings and scorecards. I grant GARAGE GAMES a non-exclusive, royalty-free license to access, view, copy, store, and share them with its judges, staff, and service providers as reasonably necessary to administer the Competition, verify and review results, investigate issues, and retain evidence required for legal obligations or claims. Waiver Section 7 separately authorizes publicity and promotional use of my workout recordings. Neither permission authorizes public display of my scorecards.
10.2 I confirm I have the rights needed for the administrative uses in these Terms and the promotional uses in Waiver Section 7, including permission from anyone who owns copyright in my recordings. I will obtain permission needed for identifiable people included in them and avoid recording unnecessary personal information, private conversations, or copyrighted music. My agreement cannot grant rights belonging to someone else. GARAGE GAMES does not guarantee confidentiality of a video I place on YouTube; that service operates under its own terms.
10.3 Uploading a profile photograph is optional. If I upload one, I grant GARAGE GAMES a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute it in connection with GARAGE GAMES competitions, including athlete profiles, leaderboards, social media, advertising, and promotion. I confirm I can grant that permission. Removing or replacing the photograph ends permission for new uses of the removed photograph; material already published need not be withdrawn, subject to applicable law. GARAGE GAMES may decline or remove a photograph.
10.4 GARAGE GAMES retains my acceptance record, including the accepted text and versions, date and time, typed name, and IP address, as evidence of my agreements. It retains submission materials and other personal information as reasonably necessary for competition administration, authorized promotional uses, legal obligations, and claims, subject to applicable privacy law. Its privacy policy is available at https://events.thegaragegames.com/privacy-terms/. Requests go to legal@thegaragegames.com.
11 Law and electronic acceptance
11.1 Texas law governs these Terms. Actions arising from them must be brought in a state court in Tarrant County, Texas, or a federal court serving that county, except where applicable law requires otherwise. Mandatory consumer, privacy, and other protections remain applicable. An unenforceable provision is omitted to the extent necessary, and the remainder continues only to the extent permitted by law.
11.2 The version accepted at registration governs my entry. GARAGE GAMES may issue revised agreements for future registrations. These Terms do not enlarge the Waiver's releases or indemnity. If wording conflicts, the Waiver controls risk, liability, and submitted-workout publicity permissions; these Terms control competition administration, administrative use of submitted materials, and optional profile photographs.
11.3 By checking the acceptance box and typing my full legal name, I intend to sign both documents electronically. I can save or print them and may request a copy at legal@thegaragegames.com. My electronic signature has the effect provided by applicable law.
